JobTatkal Terms of Service

In order to access certain features of JobTatkal, you may need to create a user account.

By using JobTatkal, you represent and warrant that:

• You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.
• You are responsible for maintaining the confidentiality of your password and account information. 
• You agree to ensure that no unauthorized individuals have access to it.
• You will be solely responsible for all activities and actions taken under your account. 

In the event of any unauthorized use or breach of security, please notify us immediately. JobTatkal will not be liable for any loss or damage arising from your failure to comply with this obligation. We reserve the right to remove, reclaim, or modify any user if we deem it to be inappropriate, obscene, or objectionable.

By utilizing our services and submitting any data, your name (or the name of your organization), email address, resumes/CVs, salary details, company information, job postings, application details, questions, or other content or information ("your data"), you are explicitly granting us an unlimited, worldwide, sub-licensable license. This license allows us to use, modify, quote, publish, translate, archive, store, reproduce, create derivative works from, and communicate your data in any manner, form, medium, or forum in accordance with our terms of service. This license encompasses all necessary rights and permissions to utilize your data effectively. 

You should only provide information you own or have the right to use. While you retain ownership of all information and data you provide or upload to the site or while using the services (including intellectual property rights), you give us the right and permission to access certain information:

• CV uploaded by you while using our services.
• Analytical information about your account, including account activity, CV upload history, job posting, prompts, and similar information.

Collecting and accessing the mentioned information is necessary for us to provide you with the services. If you choose not to provide or allow access to this information, you will be unable to access or use the Services.

We may use the provided information as long as your account is active and in accordance with our Privacy Policy and applicable law. For a more comprehensive understanding of how we handle and disclose your personal information, please refer to our Privacy Policy.

While we make efforts to ensure data availability, we cannot be held responsible for server failures or external factors beyond our control that may lead to permanent deletion, irretrievability, or temporary inaccessibility of user data.

Under this license, you agree not to engage in any of the following prohibited activities:

• Violate any applicable laws, regulations, or third-party rights.
• Access JobTatkal through automated or non-human means, whether through a bot, script, or otherwise.
• Share or utilize the user licenses by more than one individual, except for the reassignment of the license to a new user.
• Impersonate or misrepresent your affiliation with any person or entity.
• Create multiple accounts to upload the same CV at any given time.
• Modify or copy any materials from JobTatkal. 
• Use JobTatkal for any commercial purpose without obtaining prior written permission. 
• Post jobs or content on JobTatkal that seeks financial compensation, periodic payments in any form, or any other form of payment from job seekers.
• Post jobs or content that does not offer employment opportunities but instead offers services such as immigration and visa processing.
• Remove any copyright or other proprietary notations from the materials.
• Share links to third-party sites or use their logo, company name, or any other materials without obtaining their prior written permission.
• Post jobs or content on JobTatkal that include multiple job requirements/multiple job openings within a single description or posting.
• Send unsolicited e-mails and text messages or make unsolicited phone calls for the purpose of promoting and/or advertising products or services to any JobTatkal user.
• Trick, defraud, or mislead us or other users to obtain sensitive account information.
• Use information obtained from us to harass, abuse, or harm any users, employees, or anyone associated with JobTatkal.
• Upload or store material that contains software viruses, worms, or other harmful computer codes, files, scripts, or any harmful code, viruses, or disruptive content.
• Attempt to gain unauthorized access to JobTatkal's servers or networks.
• Delete copyright or proprietary rights notices from any content.
• Retrieve data or content from the site without written permission to use the site to compete with us or engage in revenue-generating activities.
• Attempt to reverse engineer, reverse assemble, reverse compile, decompile, translate, or discover the source code or underlying components of the models, algorithms, and systems used in the services.
• Attempt to probe, scan, or test the vulnerability of any system or network.
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or JobTatkal.

This account will automatically terminate if you violate any of these restrictions. JobTatkal may also terminate the license at any time without prior notice or liability.

JobTatkal and its content, including but not limited to text, graphics, images, logos, trademarks, and software, are the intellectual property of JobTatkal or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use JobTatkal for its intended purpose. You may not modify, reproduce, distribute, display, or create derivative works based on JobTatkal's content without prior written permission.

JobTatkal is built upon artificial intelligence and machine learning technologies that are continuously advancing. We strive to enhance our services to ensure they are accurate, reliable, safe, and beneficial. However, due to the probabilistic nature of machine learning, there may be instances where the output generated by our services is incorrect and does not precisely reflect real people, places, or facts. It is essential that you assess the accuracy of the output according to your specific use case.

We are committed to ongoing improvements to enhance the accuracy and reliability of our services. Please keep in mind the inherent limitations of machine learning technology and exercise appropriate judgment when utilizing the output for your intended purposes.

By providing your phone number and email address to JobTatkal, you consent to receiving various communications from us, including but not limited to:

• One-Time Passwords (OTP): For security purposes, we may send OTPs for user authentication and verification.
• Support and Feedback: You may receive communication related to customer support, assistance, and feedback on our services.
• Marketing Messages: We may send you promotional content, offers, and updates about our products and services.
• Other Communications: You may receive important notifications, alerts, and other messages related to your account or our services.

You acknowledge and agree that by providing your phone number and email address, you are giving explicit consent to JobTatkal to contact you via phone calls, SMS, or other messaging services for the purposes outlined above. We take the security of your information seriously. Your phone number and other personal data will be handled in accordance with our Privacy Policy.

By posting user content on JobTatkal, you automatically grant, and you represent and warrant that you have the right to grant, to JobTatkal an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such user content. Additionally, you grant JobTatkal the right to prepare derivative works of or incorporate such user content into other works and to grant and authorize sublicenses thereof.

We retain the prerogative to create organizational profiles for companies and create job postings on their behalf when such entities have publicly disclosed their job openings on diverse job boards and community platforms accessible to the public. However, the organization's owner or individual responsible for handling recruitment on behalf of the company reserves the right to assert control over the company's account on JobTatkal and/or may also initiate a request for the deletion or deactivation of the concerned account. JobTatkal retains the authority to review, modify, and/or delete any content posted by any individual or entity for the purpose of effecting language refinements, content polishing, stylistic improvements, fact-checking, and correction of inaccuracies, with the aim of ensuring that the content is both accurate and visually appealing to all users.

By submitting any information to JobTatkal in the form of a CV or company/job details, the individual hereby grants JobTatkal the right to utilize its AI technology for the purpose of automatically populating specific details within the individual's profile.

We will maintain certain data that you transmit to us for the purpose of managing the performance of the JobTatkal platform, as well as data relating to your use of our site. Although we perform routine data backups, you are solely responsible for all data that you transmit or relates to any activity you have undertaken using JobTatkal. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

If the same individual uploads multiple resumes beyond a reasonable limit using the same or different accounts, JobTatkal reserves the right to remove those resumes and/or terminate duplicate accounts without prior notice to the users. JobTatkal reserves the right to make modifications or edits to resumes in order to fit them into its database.

JobTatkal is provided on an "as is" and "as available" basis. While we strive to provide accurate and reliable information, we do not assume liability for the completeness, usefulness, or accuracy of the data available on its site. We are not responsible for any data posted or sent by you, other users, or third parties on our site. We shall not be held liable for any improper or incorrect use of the information provided on the site and assume no responsibility for how the information is utilized. You are solely responsible for your data and the consequences of uploading or submitting it.

Please be aware that when you, as a user, utilize third-party services, your interactions with them will be governed by their respective terms and privacy policies. JobTatkal is not responsible for the content or materials found on any third-party websites. We do not control the privacy practices of such third-party services and, therefore, cannot be held liable for any loss or damage that may arise from your use of any third-party content.

It is essential to understand that JobTatkal has no control over the accuracy of information provided by these third-party services. Data on our platform may occasionally contain technical inaccuracies or typographical errors, and we make no guarantees regarding the authenticity, accuracy, quality, copyright compliance, legality, or any other aspect of such information. As a result, any loss or damage incurred from using such information is beyond our responsibility.

By accessing and/or using the data provided through JobTatkal, you acknowledge and agree that we are not liable for any kind of damages, losses, or actions arising directly or indirectly from your interaction with and use of the data. It is your responsibility to exercise caution and diligence when relying on any information from third-party sources.

JobTatkal shall not be held liable for any loss, damage, or inconvenience resulting from your inability to access or use the platform during periods of downtime or discontinuance of the service. These terms of service do not impose any obligation on us to maintain and support the site or provide any corrections, updates, or releases related to it.

We disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, JobTatkal and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use or inability to use JobTatkal.

JobTatkal has not reviewed all of the websites linked to its platform and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by JobTatkal of the site. The use of any linked website is at the user’s own risk.

You agree to indemnify and hold JobTatkal and its affiliates, directors, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses, including attorney's fees, arising out of your use of JobTatkal or violation of these terms of service.

JobTatkal may update or modify these terms of service at any time. Any changes will be effective upon posting the revised terms of service on the JobTatkal platform. Your continued use of JobTatkal after the changes will constitute your acceptance of such changes.

JobTatkal reserves the right to suspend, disable, or terminate your access to JobTatkal at any time, without prior notice, for any reason. Upon termination, these terms of service will still apply.

• Some of our services may require a purchase or fee for access. JobTatkal services are billed in advance monthly or annually, depending on the selected plan.
• We accept only valid credit cards or other acceptable payment methods for transactions.
• Payments made for JobTatkal are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for unused months with an open account. No exceptions will be entertained.
• You agree to provide accurate and complete purchase and account information for all transactions made through JobTatkal. You are responsible for promptly updating your account and payment information, including your email address, payment method, and payment card expiration date.
• We will bill you through an online billing account for any purchases made via JobTatkal. The prices for purchases are subject to sales tax as required by us. 
• By making a purchase, you authorize us to charge your chosen payment provider for the relevant amount. If your purchase involves recurring charges, you consent to recurring charges without requiring prior approval for each occurrence until you notify us of your cancellation.
• We reserve the right to correct any errors or mistakes in pricing, even if payment has already been requested or received.

JobTatkal respects the intellectual property rights of others and expects its users to do the same. You may not use JobTatkal to infringe upon the copyrights of others.

• JobTatkal content: JobTatkal and its licensors retain all rights, titles, and interests in and to the platform, including all content, text, graphics, images, logos, trademarks, and software provided or made available through JobTatkal.
• User content: You retain ownership of any content you upload, post, or submit to JobTatkal ("user content"). By providing user content, you grant JobTatkal a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such user content on or through JobTatkal for the purpose of providing the services. You also grant us permission to use the content on other platforms including but not limited to Meta (Facebook), Instagram, Twitter, Pinterest, LinkedIn, and YouTube. 

If you believe that any content on JobTatkal infringes your copyright, you must provide JobTatkal with a written notice that includes specific information mentioned below:

• Details pertaining to the copyrighted work that has been allegedly infringed, and provide a representative list if there are multiple works.
• Describe where the infringing content is located on our platform(s).
• Include your contact details, such as address, telephone number, and email address, so we can reach you.
• State that you have a good faith belief that the use of the identified content is not authorized by the copyright owner, its agent, or the law.
• Make a statement, under penalty of perjury, that the information provided in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
• Provide the physical or electronic signature of the copyright owner or someone authorized to act on their behalf.

Upon receiving your notice, JobTatkal will promptly investigate any properly substantiated claims of copyright infringement and take appropriate action, including removing or disabling access to the allegedly infringing content.

JobTatkal reserves the right to terminate user accounts or access to JobTatkal for users who repeatedly infringe upon the copyrights of others. JobTatkal is not responsible for resolving disputes between users or third parties regarding alleged intellectual property infringement.

These terms of service and your use of the JobTatkal site shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of India.
